Atalink Ltd shall not be liable (whether for breach of contract, negligence or for any other reason) for any failure by you to contact an advertiser of a position for employment or to secure a position for employment, loss of salary, loss of profits, exemplary or special damages, loss of sales, loss of revenue, loss of goodwill, loss of any software or data, loss of bargain, loss of opportunity, loss of use of computer equipment, software or data, loss of or waste of management or other staff time, or for any indirect, consequential or special loss, arising out of the use or performance of this Site, the provision of or failure to provide the Services, or for any information obtained through this Site, or otherwise arising out of the use of this Site, whether based on contract, tort, or otherwise, without limitation, even if ATALINK LTD has been advised of the possibility of damage.

If you are dissatisfied with any portion of this Site, or with any of these Terms of use, your sole remedy, except as specifically provided in these Terms, is to stop using the Site.

Advertisements for positions are placed by the Employers and are not the responsibility of nor endorsed by ATALINK LTD. You agree that the obtaining or viewing of any advertisements for positions or any other material through the use of the Service is carried out at your own risk and that ATALINK LTD has no liability to you in respect of such things. In particular, we do not warrant or guarantee at any time that you will receive any alerts from Employers regarding potential positions.

You agree that your use of the Service is on an "as is" and "as available" basis and that your use of the Service is at your sole risk. ATALINK LTD expressly disclaims all conditions, warranties or other terms in relation to the Site or the Service and in particular none as to any contents or accuracy of any advertisement for any position of employment (including any implied term as to quality, fitness for a particular purpose or compliance with any codes or laws relating to advertising, employment or discrimination), warranties of technical efficiency, satisfactory quality, availability, non-infringement, completeness and fitness for a particular purpose.

ATALINK LTD may change the format and content of the Site and/or the Services from time to time without warning. You should refresh your browser each time you visit the Site to ensure that you download the most up to date version of the Site. Without prejudice to any other accrued rights, ATALINK LTD may make available such information or material when required to do so by law or when requested to do so by regulatory bodies or law enforcement organisations.

GENERAL

Unless otherwise specified, the Site is directed solely at those who access this site from the United Kingdom. Those who choose to access the Site from locations outside of the UK are responsible for compliance with local laws if and to the extent local laws are applicable.

These Terms form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter (save that these Terms shall not prejudice the agreement between ATALINK LTD and Employers in relation to roles advertised). If any provision of these Terms is found to be unenforceable, this shall not affect the validity of any other provision.

ATALINK LTD may delay enforcing its rights under these Terms without losing them.

None of these Terms shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any third party.

You agree that ATALINK LTD may sub-contract the performance of any of its obligations or may assign these Terms or any of its rights or obligations without giving you notice.

Any and all notices to be given by either one of us to the other pursuant to or in connection with these Terms shall be deemed sufficiently given when forwarded by e-mail or facsimile transmission in each case addressed to you at the e-mail address or facsimile number you have given us or to us at the e-mail address or facsimile number displayed on the Site.

These Terms shall be governed and interpreted in accordance with English law and you consent to the exclusive jurisdiction of the English courts.

TERMINATION

You acknowledge that there may be periods where access to or use of the Site or pages linked to it may be limited or impossible due to changes effected to the Site by way of ongoing development and improvement.

ATALINK LTD may restrict your access to the Website, refuse to correspond with you, remove your details from the relevant database and/or terminate the Services without prejudice to any accrued rights, without prior notice to you where:

o there is a regulatory or statutory change limiting the ability to provide access to the Site;

o there is any event beyond the reasonable control of ATALINK LTD preventing ATALINK LTD from providing access to the Site (for example and without limitation, technical difficulties, capacity problems and communications failure);
